This Workmanship Warranty (the “Warranty”) is provided by Marlow Roofing, hereinafter referred to as the “Contractor,” to the customer, hereinafter referred to as the “Client.” This Warranty covers the workmanship provided by the Contractor for building and roofing work performed at the Client’s property, as described in the contract or agreement between the Contractor and the Client.
- Scope of Warranty: 1.1 The Contractor warrants that all workmanship performed by their employees or subcontractors will be free from defects and will meet industry standards. 1.2 This Warranty specifically covers any issues arising from faulty workmanship, such as errors in installation, poor craftsmanship, or non-compliance with applicable building codes, within the specified warranty period.
- Warranty Period: 2.1 The warranty period for the workmanship provided by the Contractor shall be specified on the invoice from the date of completion or substantial completion of the project 2.2 Any claims made under this Warranty must be reported to the Contractor in writing within 30 days of the discovery of the alleged defect.
- Contractor’s Obligations: 3.1 Upon receiving a written notice of a warranty claim within the specified timeframe, the Contractor will promptly investigate the claim and, if found valid, will repair or replace the defective workmanship at no additional cost to the Client. 3.2 The Contractor reserves the right to inspect the alleged defect to determine the cause and validate the claim before proceeding with repairs or replacements. 3.3 The Contractor’s obligations under this Warranty are limited to the cost of labour and materials necessary to rectify the defective workmanship, as determined by the Contractor.
- Exclusions: 4.1 This Warranty does not cover damage or defects caused by: (a) Accidental or intentional damage by the Client or third parties. (b) Normal wear and tear, or failure to properly maintain the building or roof. (c) Acts of nature, including but not limited to, earthquakes, storms, floods, or other natural disasters. (d) Unauthorized modifications or alterations made by the Client or third parties. 4.2 The warranty does not extend to any components or materials supplied by third-party manufacturers or suppliers. The Client shall be subject to the respective warranties provided by those manufacturers or suppliers.
- Transferability: 5.1 This Warranty is transferable to subsequent property owners, provided that the Client notifies the Contractor in writing within 30 days of the property transfer, and the subsequent owner agrees to be bound by the terms and conditions of this Warranty.
- Governing Law: 6.1 This Warranty shall be governed by and construed by the laws of England & Wales
